Failing To Stop or Report An Accident Penalty

You could be at risk of receiving as many as 10 penalty points for bumping into a bollard and not stopping to report this. An allegation of failing to stop or failing to report an accident can be brought if you did not stop at the scene of accident and provide your details after causing damage to another vehicle or property (fence / lamppost) or if you did not report it to the Police as soon as possible.

I didn’t know I’d had an accident!

If you are unaware that you have had an accident this could be a genuine defence to the allegation of failing to stop or report the accident. However, it is not a defence to say the damage was only minor and so you did not think you had to stop.

Fighting the allegation

The allegation of failing to stop or report an accident should be taken seriously as in extreme circumstances, particularly in the case of a “hit and run” incident it can lead to a custodial sentence. However, it is often the case that there are gaps in the evidence concerning identity and evidence of an accident or incident requiring a report.

Pleading Guilty

There are a number of punishments which the Court can impose for this offence they are:

  • A fine;
  • A community order; or
  • Up to 26 weeks custody; and
  • A disqualification of between 12 and 36 months; or
  • 5 – 10 penalty points.

If you were to plead GUILTY to the offence of careless driving it is important to have a specialist representative to ensure that the Court imposes the lowest penalty possible especially if you are at risk of a custodial sentence.
